Be the 2017 Beauty Vlogger of the Year

Submit your best makeup tutorial video for a chance to win $10,000 AUD and become NYX Professional Makeup 2017 Beauty Vlogger of the Year.

1. Upload a new or existing YouTube makeup tutorial showing us your favorite look.
Videos will be judged on how well it shows off your artistry, talent, presentation and quality of the video. Check out our guidelines below.

2. Upload your submission video to YouTube
You will have to create an account, if you don’t have one already. Videos can be new or an existing video.

3. Fill out and submit the entry form (will be available April 4th).
Open submissions will be accepted until April 24th, 2017 at 11:59pm PT.

4. Hang tight. Finalists will be notified by email on April 28th, 2017.

1. Eligibility and How to Enter:

  1. Eligible entrants/voters:

    1. Entry and voting is only open to Australian and NZ residents who are 14 years and over. Entrants/voters under the age of 18 must have parent or legal guardian approval to enter/vote.
    2. Employees (and the immediate family members) of agencies/companies directly associated with the conduct of this Promotion, the Promoter, its distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter or vote. "Immediate family member" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  2. Potential winners/finalists are subject to verification of eligibility and identity per these Conditions of Entry, which will include a background check and completion of documentation required by Promoter to complete such background check, the results of which must be completely satisfactory as determined by the Promoter in its sole discretion. Additional eligibility requirements apply for winners/finalists, as described herein. Winning a prize is contingent upon fulfilling all requirements set forth herein, including the Promoter’s approval of the results of a background check.
  3. Entrants agree that during the period 4 April 2017 – 9 July 2017, they will not post any submissions (“Submissions”) provided to the Promoter in connection with this Promotion, including the Video Entry Submission (defined below), on Facebook or any other social network. Entrant must have permission from the model and any other individuals who appear in a Submission consent to the use of the Submission in this Promotion and to use their names and likenesses in the Submission and to grant the rights set forth herein. Other than the entrant, all other individuals included in a Submission must be at least 18 years of age. If requested, entrant must be able to provide such permissions or proof in a form acceptable to the Promoter. Additional Submission requirements:
    1. Entrants Submissions must be his/her original work.
    2. Entrant may not make any claims or beliefs (positive or negative) about any product or its performance in a Submission.
    3. Entrant may not make any statement about a brand other than NYX Professional Makeup (including mere reference of its use).
    4. Product logos and brand names other than NYX Professional Makeup may not be displayed.
    5. Submissions must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement.
    6. Submissions must not disparage the Promoter or any other person or party.
    7. Submissions must not contain brand names or trademarks other than those owned by the Promoter, which entrant has a limited license to use to incorporate in his/her Submission in this Promotion.
    8. Submissions may only contain music provided by the Promoter.
    9. Submissions must not contain any content not created by entrant.
    10. Submissions must not contain material that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous.
    11. Submissions must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and
    12. Submissions must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any State/Territory where Submission is created.
  4. Submissions generated by script, macro or other automated means are void.
  5. Initial Submission Phase - How to Enter:

    1. Entries open at 12:00 am AEDT on 04/04/17 and close at 11:59 pm AEST on 24/04/17 (“Entry Period”).
    2. To be eligible to enter, an entrant must make or have previously made a makeup tutorial video which shows us your favourite makeup look and that best exemplifies your talent as a Beauty Vlogger (“Video Entry Submission”).
    3. Video Submission Requirements:The Video Entry Submission must meet the following requirements:

      1. You may make up your own face or use a model in the video.
      2. If you use a model in your video, your model must be at least eighteen (18) years of age.
      3. You may use any cosmetic products you would like however brand names and logos of products other than NYX Professional Makeup must not be displayed or mentioned in your video. Your use of or reference to NYX Professional Makeup’s products will not positively impact the finalist/winner determination process.
      4. Must not exceed 15 minutes.
      5. Must be in English.
      6. Must be in a format that is compliant with formats that YouTube guidelines: avi, flv, mov, mp4, mpeg4, mpegps, 3gpp, webM,or wmv format.
      7. Must meet YouTube's Terms of Service at http://www.youtube.com/static?gl=US&template=terms and its Community Guidelines at http://www.youtube.com/t/community_guidelines; and
      8. Must be uploaded to your YouTube account. YouTube account must be non-private. Entrants will need to create a YouTube account if they don’t have one already. For the sake of clarity, videos submitted may be new or existing.
    4. If you do not have a YouTube account, go to www.YouTube.com and create an account according to the instructions on the website. Creating an account is free and you may be asked to agree to the terms of service and privacy policy of the relevant platform. This Promotion is in no way Promoted, endorsed or administered by, or associated with YouTube. If you choose to enter using your mobile phone, standard data fees may apply.     5. To enter, an entrant must complete the following steps during the Entry Period:
      1. Visit faceawards.nyxcosmetics.com.au follow the prompts to the registration form; and
      2. Input the requested details, including their full name, phone number, valid email address, a valid home address, and a YouTube link to their Video Entry Submission.
      3. A guideline video may be included on the registration website. If so, the entrant must ensure their submission matches the requirements and restrictions outlined in this guideline video in addition to any conditions set out herein.
    6. By entering this Promotion and agreeing to these Conditions of Entry, each entrant represents and warrants that he or she is the person listed on the entry form. By uploading submitting your Video Entry Submission as part of the entry requirements, or any other submission to the Promoter during this Promotion, you agree that it conforms to the guidelines, requirements, permissions, and content restrictions listed herein and that the Promoter, in its sole discretion, may disqualify you if it believes that it fails to conform.
    7. Your use of or reference to Promoter’s products will not positively impact the Winner Determination process

  6. Entry/Submission Limits:

    Each entrant may upload one (1) Submission in the Initial Submission phase (Stage 1) and if invited, may provide a maximum of one (1) Submission to the Promoter for Semi-Finalists Challenges. Submissions received from any person, email address or YouTube account in excess of the stated limit will be void.

3. Agreement to Official Rules:

  1. The name of this promotion is the AUSTRALIAN FACE AWARDS (“Promotion”).
  2. Entrants and voters agree and acknowledge that they have read these Conditions of Entry and that participation in the Promotion is deemed to be acceptance of these Conditions of Entry. Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.
  3. Entries/votes are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant/voter. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
  4. Valid and eligible entries and votes will be accepted during the required entry/voting periods specified herein.
  5. All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may collect entrants' personal information (including through its contractors or agents) or disclose entrants' personal information to its contractors and agents to assist in conducting this competition or communicating with, or developing its relationship with, entrants including to overseas locations such as Australia (for NZ entrants), New Zealand (for Australian entrants), the USA, Canada, Singapore and other countries in Asia and the EU. By entering this promotion, entrants consent to the storage of their personal information on the Promoter's database and the Promoter may use this information for future competition and marketing purposes regarding its products, including contacting the entrant via electronic messaging. By entering this Promotion, entrants consent to receiving SMS or email messages from the Promoter. The Promoter is bound by the Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address stated in the Promoter section of these conditions. The Promoter's Privacy Policy, located at www.loreal.com.au/_en/_au/tools/privacy/privacy_1.aspx, contains information about: (a) how entrants can seek access to the personal information the Promoter holds about them and seek the correction of such information; and (b) how entrants can complain about a privacy breach and how the Promoter will deal with such a complaint.
  6. For the purposes of public statements and advertisements, the Promoter may only publish the winner's surname, initial and State/Territory/Country or postcode of residence.
  7. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of a prize, if the Promoter determines in their absolute discretion, that a winner is not in the physical or mental condition necessary to be able to safely participate in or accept the prize. It is a condition of accepting the prize that a winner (or their parent or legal guardian if under the age of 18) may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving a prize. If a winner is under the age of 18, a nominated parent or legal guardian of the winner will be required to sign the legal release on the winner’s behalf.
  8. If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier and the provision of the prize is the sole responsibility of the third party and not the Promoter. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Conditions of Entry, to the extent of any inconsistency. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise
  9. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Consumer Guarantees Act 1993 (NZ) and/or Fair Trading Act 1986 (NZ) and the Competition and Consumer Act 2010 (Cth).
  10. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify suspend the Promotion and invalidate any affected entries, or suspend or modify a prize.
  11. The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant's details (including an entrant's identity, age and place of residence). In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
  12. By participating in this Promotion, entrant acknowledges and agrees that Promoter may obtain many Submissions in connection with this Promotion and/or other Promotions staged and/or promoted by the Promoter, and that such Submissions may be similar or identical in theme, idea, format or other respects to entrant's Submission. Moreover, entrant acknowledges that his/her Submissions may be similar to materials developed by the Promoter. Entrant waives any and all claims entrant may have now or in the future that any compensation is due to entrant in connection with any Submission or other material provided.
  13. All material submitted on entry (e.g. Submission(s), Video Entry Submission(s), video(s), photo(s), image(s), drawing(s), comment(s), sound/video recording(s) and answer(s) to a promotional question) must NOT: (a) be in breach of any laws, regulations and rights, e.g. any laws regarding intellectual property (copyright, trademarks, etc), defamation and privacy; (b) be defamatory, obscene, derogatory, pornographic, sexually inappropriate, contain nudity, aggressive, violent, abusive, harassing, threatening, objectionable or discriminate/vilify any section of the community with respect to race, ethnicity, nationality, religion, origin, sexual preference, mental illness, disability or gender or unsuitable for publication; or (c) contain viruses. Entrants warrant that they own or have the right to license the copyright in any entry submitted by them into this Promotion, for the purposes of this Promotion, that no rights have been granted to any third party in respect of any such entry which would prevent the entry being used as contemplated by this Promotion, and that the use by the Promoter of any such entry will not breach any laws or infringe the rights of any person (including without limitation with respect to privacy, intellectual property and defamation). Entrants must obtain prior consent from any person or from the owner(s) of any property that appears in their entry. By entering, all entrants license and grant the Promoter, its affiliates and sub-licensees an exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (including any portion of their entry) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability. Entrants further agree, upon request by the Promoter, to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter and to sign any legal documentation to confirm such assignment. Entrants agree that their entry is their original work and does not infringe the rights of third parties, or that they have obtained full prior consent from any person who has jointly created or has any rights in the aforementioned material. Entrants consent to any use of their entry that may otherwise infringe their moral rights. Entrants are responsible for all entries they submit on entry. The Promoter will not be liable for any entries, to the extent permitted by law. The Promoter reserves the right to remove, request removal or decline to publish any entry or portion of an entry for any reason whatsoever, including if in breach of these Terms and Conditions. The Promoter will have no liability to entrants if it exercises this right and entrants must comply with any request made by the Promoter pursuant to this paragraph. The entrant warrants and represents that any material sent or provided by the entrant to the Promoter will not infringe any copyright, trademarks or other intellectual property rights of any third party (including moral rights) and that the entrant has all rights to use the materials and has obtained all necessary consents to comply with any relevant privacy and/or confidentiality requirements. Entrants agree to indemnify the Promoter for any breach of the Terms and Conditions including this clause.
  14. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Conditions of Entry. In the event that there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.
  15. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  16. Unless otherwise specified, a prize is a single event for the winner (and where relevant their guests) and cannot be separated into separate events or components.
  17. The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.
  18. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.

6. No Compensation Provided:

  1. No compensation will be provided to an entrant for any material submitted by an entrant in conjunction with this Promotion.

7. Determination of Semi-Finalists and Finalists:

  1. Overview of Finalists/Semi-Finalists/Grand Prize Winner Determination:
    1. Winners will be determined by the following process: First, the Promoter will select thirty (30) Semi-Finalists based on the objective judging process described below. Semi-Finalists will be invited to participate in up to three (3) additional video challenges. The public will be permitted to vote on the Semi-Finalist's Submissions and those with the highest number of votes will be invited to continue. The final six (6) entrants ("Finalists") will be invited to participate in the Final Submission process that will take place in Melbourne, Victoria. Failure to timely provide Semi-Finalist Submissions or compete other requirements listed below may result in forfeiture of a prize. The full process is described below
    2. After the conclusion of the Initial Submission phase, a panel of qualified judges determined by Promoter in its sole discretion will select the thirty (30) entrants with the highest-scoring Video Entry Submissions (the "Semi-Finalists") from among all eligible Submissions based on the following criteria (“Judging Criteria”):
      1. 40% Creativity of the look;
      2. 30% Artistry in makeup application;
      3. 20% Presentation of theme
      4. 10% Quality of the video production;
    3. Winner determined at the Live Finale by public voting during the Live Stream on Microsites (50% votes) and by selected live judging panel (50% votes)
  2. In the event of a tie, the entrant whose Video Entry Submission received the highest score for “creativity of the look” as determined by the qualified judges, in their sole discretion, will be deemed the applicable Semi-Finalist. In the event of a tied high score in “creativity of the look” the tied high scores will be re-judged and the one with the highest score will be deemed the Semi-Finalist. The Promoter reserves the right to select fewer than thirty (30) Semi-Finalists, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Video Entry Submissions. The thirty (30) selected entrants will be notified by email or phone, using information provided on the entry form.
  3. Video Challenges for Invited Semi-Finalists: The thirty (30) Semi-Finalists selected after the first challenge must be prepared to participate in up to three (3) additional video challenges, as described below to continue in the Promotion.
  4. Prior to the beginning of each Video Challenge (dates set forth in the chart above in the Important Dates section above), the applicable Semi-Finalists will be invited to participate. Promoter will announce the theme for each Video Challenge online at faceawards.nyxcosmetics.com.au at the beginning of each Video Challenge. Semi-Finalists must create a Submission consistent with the theme provided and all of the guidelines, requirements, permissions, and content restrictions listed herein. Submissions provided after the end date for the applicable Video Challenge may not be included in the gallery for public voting.
  5. Public Voting: After each Video Challenge, there will be a public voting period. During each of the three (3) Public Voting Phases, (dates/times set forth in the Chart in the Important Dates section above), the applicable Semi-Finalists’ Submissions will be posted for public voting at faceawards.nyxcosmetics.com.au. Individuals may vote for the Submission they believe is the best. Limit: three (3) votes per e-mail address and per person, each day during the applicable Voting Phase. For the purposes of this Promotion a day is defined as beginning at 12:00 AM (midnight) AEDT and ending at the following 11:59 PM AEDT. On the days in which the Voting Phrase opens at 12:00 PM AEDT, voting for that day ends at 11:59 PM AEDT. Multiple votes received from any person or email address in excess of the stated number will be void. Any attempt by any Semi-Finalist or voter to obtain votes by any fraudulent or inappropriate means, including without limitation, offering prizes or other inducements to members of the public as determined by Promoter in its sole discretion, by using any automated program, by using multiple/different email addresses, identities, registrations and logins, or any other methods, will void those votes for the Submission and Semi-Finalist may be disqualified as determined by Promoter in its sole discretion. Promoter reserves the right, in its sole discretion, to revise the vote counts should the voting as a whole appear to have been tampered with or manipulated in significant way.
  6. Determination of Semi-Finalists that Continue in the Promotion: After each public Voting Phase, the Submissions with the most valid votes will proceed to the next Challenge. In the event of a tie in votes after any of the Public Voting Phases, Promoter will select the applicable Semi-Finalist to continue in the Promotion using the Judging Criteria listed above to score the applicable Challenge Submission. The number of Semi-Finalists that will continue in the Promotion for each Challenge is as follows:
    1. Top Twenty (30) Semi-Finalists will be invited to participate in the 2nd Video Challenge.
    2. Top Fifteen (15) Semi-Finalists will be invited to participate in the 3rd Video Challenge.
    3. Top Six (6) Finalists will be invited to participate (pending confirmation and passing a background check) in the Final Challenge in Melbourne.
  7. Promoter will notify the Semi-Finalists who will continue by email and/or phone prior to the beginning of the next Challenge Submission Phase.
  8. Final Contest: Final Contest is in MELBOURNE, in August. The Promoter will provide the Finalists work space and selection of NYX Professional Makeup (all determined by Promoter in its sole discretion) and a final theme. Finalists will be directed to create a ninety (90) second video Submission that shows the final look created at a time provided by the Promoter. The final Runway Show will be filmed and will be streamed live. At the final Runway Show, each Finalists will be permitted to introduce his/her Submission and show the Submission for the final panel of Judges and those watching the live stream. After all of the Finalist's Submission are presented, the moderator will invite the public to vote (at http://faceawards.nyxcosmetics.com.au) on one (1) Submission that they like the best. The Final judging panel (made up of four (4) judges selected by Promoter) will score each of the Finalist's Submissions based on the following Judging Criteria:
    1. 40% Creativity of the look.
    2. 30% Artistry in makeup application.
    3. 20% Presentation of theme; and
    4. 10% Quality of the video production
  9. The Finalist with the highest-scoring Final Submission will be deemed the potential Grand Prize winner and the remaining Finalists will be deemed potential First Prize winners. In the event of a tie, the Finalist with the highest score for Overall Composition and Quality of the Submission will be deemed the potential Grand Prize Winner. Promoter reserves the right to not select a Grand Prize winner or all five (5) First Prize winners, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Submissions. The Grand Prize winner will received the Grand Prize.
  10. 10. Additional Activities and Requirements during the time in Melbourne During this week, Promoter will film Finalist during various activities, including visit to Promoter's headquarters and when Finalist meets with a professional team of models, and stylists ("Prize Footage"). Prize Footage will be used to create a vignette that will be shown at the Final Runway Show. Promoter and its agents shall have the right to edit, exploit, adapt, distribute, post, create derivative works of, and otherwise use the Prize Footage, in whole or in part, together with the Promoter’s and NYX Professional Makeup’s name, and in combination with other materials, in any manner, for any advertising, promotional, trade, commercial or other purposes in any and all media, now or hereafter devised, worldwide without limitation and without further payment, notification, permission or other consideration to winner or any third party, except where prohibited by law. Promoter shall not incur any liability whatsoever to the extent Promoter chooses to refrain from any exploitation of its rights hereunder.

8. Finalist Notification:

  1. Finalist Notification: The potential six (6) Finalists will be notified by email or phone using contact information provided on the entry form. The potential Finalists (or parent or legal guardian where entrant is a minor in his/her place of locations) will be required to sign and return a legal document regarding eligibility and publicity, including agreement for Promoter to perform a background check, which must be received by Promoter within three (3) days of the date notice or attempted notice is sent, in order to claim his/her prize. The potential Finalists will be confirmed upon the Promoter’s satisfaction with and approval of the results of the background check. If a potential Finalist cannot be contacted, fails to execute and return a required legal document or provide any other requested information within the required time period (as applicable), does not comply with these Conditions of Entry, or notification is returned as undeliverable, potential Finalist forfeits the prize. If a potential Finalist is disqualified for any reason, the applicable prize may be awarded to a runner-up, if any, in Promoter’s sole discretion.

9. Finalist Travel, Submission & Judging and Additional Requirements:

  1. Finalist Travel, Submission & Judging and Additional Requirements:
    1. The Finalists, including one parent or legal guardian of each Finalist who is a minor, will be provided a fourteen (14) night stay in Melbourne, Victoria, to attend the Final Content which includes:
      1. Return economy class airfares from their nearest Australian capital city (if from outside of Victoria) or nearest of Auckland, Christchurch, Wellington and Queenstown (if from NZ), to Melbourne, VIC (only provided if winner does not reside in Victoria, Australia).
      2. One (1) standard room double occupancy hotel room at a hotel selected by Promoter with a ranking of three or more stars (to be shared by Finalist and his or her parent or legal guardian for any Finalist who is a minor).
      3. A AUD$50 per day for meals and beverages (for each Finalist and for the parent or legal guardian of any Finalist who is a minor) (only provided if winner does not reside in Victoria, Australia).
      4. Reimbursement for ground transportation to and from the hotel and Melbourne airport for a maximum of $65 AUD per one-way transport (to be shared by Finalist and his or her parent or legal guardian, if the Finalist is a minor) (only provided if winner does not reside in Victoria, Australia); and
      5. Transportation to the event location(s) as specified by the Promoter.
    2. All other expenses not specified above including, but not limited to, all other meals, beverages, gratuities, incidentals, taxes, other ground transportation, and baggage handling fees for bags in excess of one bag per Finalist (and the parent or guardian of a Finalist who is a minor), are the sole responsibility of each Finalist. Final actual value at time of booking and travel may be substantially more or less depending on point of origin and ticket availability. Finalists and the parent or legal guardian of any Finalist who is a minor shall reasonably cooperate with Promoter to arrange for the prompt booking of their travel arrangements. All airline or other travel tickets once booked cannot be changed unless Promoter in its sole discretion consents. Any additional fees or penalties incurred as a consequence of any changes made to any travel arrangements after they are booked that are made at the request of a Finalist (or his or her parent or legal guardian) are the sole responsibility of such Finalist (or his or her parent or legal guardian). All Finalists (and his or her parent or legal guardian, for any Finalist who is a minor), are solely responsible for obtaining any necessary travel documents, including photo identification, visas and/or passports. Promoter does not provide travel or other insurance.

10. Prizes:

  1. Prize Details:
    1. ONE (1) GRAND PRIZE:Consists of the following – AWARDED TO THE GRAND PRIZE WINNER ONLY:
      1. $10,000 AUD cash (awarded via either EFT to a bank account in the winner’s name or a cheque made payable to the winner, as determined by the Promoter).
      2. The title of NYX Professional Makeup Australia & NZ 2017 Beauty Vlogger of the Year.
      3. $1,000 AUD worth of NYX Professional Makeup products, as determined by Promoter; and
      4. Industry consultation with a corporate sponsor of the Final Event to be selected by Promoter in Los, Angeles (date to be selected by Promoter in consultation with Grand Prize Winner. In the event of a dispute regarding date consultation is to the taken, the Promoter’s decision will be final). This portion of the prize includes return flights for the winner only from the winner’s nearest Australian capital city (if from Australia) or from their nearest NZ city of Auckland, Christchurch, Wellington and Queenstown (if from NZ) to Los Angeles, USA, and accommodation for up to 10 nights in Los Angeles. Any Grand Prize winner must be accompanied by a parent or legal guardian for this trip if under 18 years of age – and costs for their return economy flights from Aust/NZ to Los, Angeles will be provided by the Promoter.
    2. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Promoter. Actual value of may vary based on point of departure. Any difference between stated value and actual value will not be awarded. Trip must be taken on dates specified by Promoter or prize will be forfeited and Promoter will have no further obligation to such winner. Promoter reserves right to change dates. Travel must be made through Promoter’s agent, on a carrier of Promoter’s choice. Winner may not substitute, assign or transfer prize or redeem prize for cash, but Promoter reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. All prize details are at Promoter’s sole discretion.
  2. Applicable to all travel awarded: Spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs unless otherwise specified as included in the prize description, are not included and is the responsibility of the Finalist/Grand Prize Winner. Frequent flyer points will not be awarded and do not form part of a prize. No part of a prize is exchangeable, redeemable for cash or any other prize or transferable. The Grand Prize winner is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The Finalists/Grand Prize winner (and their companion, if applicable) must depart from and return to the same departure point and travel together. The Finalists/Grand Prize winner may be required to present their credit card at check in. Prize is subject to the standard terms and conditions of individual prize and service providers. Travel itinerary will be determined by the Promoter in its absolute discretion. Subject to the terms and conditions of the participating prize provider(s), if for any reason the winner does not, once the prize has been booked, take the prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
  3. For the sake of clarity, all travel arrangements awarded to the Finalists as specified herein, are considered a prize for the purposes of these terms.
  4. If a prize is won by a person under the age of 18, the prize may be awarded to the winner's parent or guardian and where applicable to the prize a nominated parent/guardian must accompany any person under 18 years of age.
  5. The Finalists/Semi-Finalists/Grand Prize winner will be determined by skill. Chance plays no part in determining the Finalists/Semi-Finalists/Grand Prize winner. The judges' decision is final and binding and no correspondence will be entered into. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.
  6. All reasonable attempts will be made to contact each winner.
  7. If any winner chooses not to take their prize (or is unable to), or does not take or claim a prize by the time specified by the Promoter, or at the time stipulated by the Promoter for travel, they forfeit the prize and the Promoter is not obliged to substitute the prize
  8. The value of the prizes is accurate and based upon the recommended retail value of the prizes (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prizes after that date.
  9. If a prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the prize (or that portion of the prize) to a prize of equal or greater value and/or specification.
  10. No entry fee is charged by the Promoter to enter the Promotion.
  11. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.

11. Publicity:

  1. The entrant will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them.

12. Release/Limitations of Liability:

  1. To the extent permitted under law, the Promoter and its associated agencies and companies (“Released Parties”) are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Submission process or the Promotion; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of the Promotion, the uploading, the processing or judging of Submissions or votes or the tabulating of votes, the announcement of the prizes or in any Promotion-related materials; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize (including any travel/activity related thereto). Released Parties are not responsible for misdirected or undeliverable Submissions or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Released Parties are not responsible for any unauthorized third-party use of any Submission.
  2. Except where prohibited by law, as a condition of participating in this Promotion, participant agrees that if there are any and all disputes and causes of action arising out of or connected with this Promotion, or any prizes awarded, it shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including solicitors' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion), and participant further waives all rights to have damages multiplied or increased.
